Guidelines for Business Control and Design of Cyber Center / Cyber Cafe City Council Shah Alam


1. LICENSING


1.1 Licensing of cyber center and cyber cafe premises is subject to the Cyber ​​Center and Cyber ​​Cafe Bylaws or any other written laws in force in Malaysia or other bylaws deemed appropriate by the local authority.


1.2 The license issued by the local authority must be displayed at the premises registration counter.


2. MANAGEMENT


2.1 The licensee must manage the cyber center and cyber cafe professionally and appoint a manager who has extensive knowledge in this field.


2.2 License holders are not allowed to hire any foreign nationals to work in cyber centers and cyber cafes and must register with the PBT to obtain an employee pass/card that will be issued by the PBT.


2.3 The licensee is not allowed to hire workers under the age of 18.


2.4 The licensee must ensure the use of a 'firewall' as 'web filtering' to prevent access to pornography, gambling or any other websites or access that will be determined from time to time by the Licensing Authority.


2.5 The licensee must provide sufficient employees (minimum of 2 employees) at all times to supervise every activity on the premises of the cyber center or cyber cafe.


2.6 Entrepreneurs are prohibited from displaying advertisements without a license issued by the Licensing Authority.


3. GENERAL REQUIREMENTS FOR THE DESIGN OF A CYBER CENTER OR CYBER CAFE


3.1 The door or front wall of the premises must use glass or any other transparent material and is not allowed to be colored or plastered with any material that obstructs vision.


3.2 The premises must be open concept with a bright lighting system.


3.3 The position of the computer must be placed in open that is without rooms, without doors and the use of 'partitions' is not allowed.


3.4 Displaying the prohibitions at the front door of the premises (the size of the sign must be adjusted).


3.5 The number of computers allowed is based on size: no less than 3m² = 1 computer unit.


3.6 Standardize cyber center/ cyber cafe signs. It is recommended to use a uniform background color, for example: yellow.


3.7 Food and beverage preparation / sale activities or any ancillary activities must be in a separate room from cyber center and cyber cafe activities.


3.8 Provide adequate resting space for customers.


3.9 Ensure that the conditions in and around the premises must always be clean and orderly.


3.10 All stairs, walkways, platforms and exits are free of obstructions and all exits must be accessible at all times during operating hours.


3.11 Provide perfect and adequate toilets and separated for men and women and must be clean at all times.


3.12 Provide trash cans in sufficient number and should be closed at all times.


4. PERMITTED ACTIVITIES


4.1 The main activities of the cyber center and cyber cafe are limited to dissemination activities and obtaining information via the internet only.


4.2 Online game activities (online games) or 'server games' are permitted by complying with other written laws applicable in Malaysia.


4.3 License holders of cyber centers and cyber cafes shall be responsible for ensuring that no unhealthy activities occur in cyber centers and cyber cafes throughout the operating hours. Immediate action should be taken in the event of unhealthy activities within the premises of cyber centers and cyber cafes.


5. OPERATION TIMES


5.1 Cyber ​​centers and cyber cafes can only operate until 12.00 midnight only and must comply with the following basic conditions:


(i) Visitors under the age of 12, are allowed to visit the cyber center and cyber cafe until 10:00 pm only when accompanied by a parent or legal guardian at all times;

(ii) Visitors aged 18 and above are allowed to visit the cyber center and cyber cafe until 12.00 midnight only;

(iii) Students in school uniform are prohibited from entering or being in the premises of the cyber center or cyber cafe.


6. AREA OF OPERATION


6.1 Cyber ​​centers and cyber cafes are allowed to operate:-


i. Business Complex;

i. Shop House/Office Shop (Ground Floor only);

iii. Self-built premises in a rural area

(temporary approval with the permission of the area Councillor).


6.2 Cyber ​​centers and cyber cafes are not allowed to operate near sensitive areas such as mosques, houses of worship and other areas designated by the Licensing Authority. The minimum distance allowed should be at least 500 meter radius from the area.


6.3 Established quotas for certain areas:-


i. Near the Higher Education Center;

ii. New Development Area.


7. PROHIBITIONS


7.1 Not allowed :-


i) Any form of gambling activity;

ii) Uploading, downloading or accessing images, videos or articles that are indecent or obscene and that have incitement elements;

iii) The sale of any printed material with negative and obscene elements;

iv) Any form of entertainment activities including central broadcast music (pipe music);

v) Students wearing school uniform inside the premises;

vi) Any sale or use of alcoholic beverages, cigarettes or dangerous drugs on the premises;

vii) Customers smoke inside the premises;

viii) Showing or exhibiting any images that are not in accordance with the customs, religion and moral values ​​of Malaysian society;

ix) Any unhealthy activity in the premises


7.2 Provide a 2' x 2' size sign stating the prohibitions in paragraph 7.1 and operating time conditions. The sign must be displayed at the front entrance of the premises.


8. CUSTOMER REGISTER BOOK


8.1 The licensee must provide a record book of customer register entries containing the following details:


i) Customer name;

ii) Identification card number or passport number;

iii) Current address;

iv) Age;

v) Start and end time of use; and

vi) Name of school and class (if necessary)


8.2 The customer entry record book must be updated at all times, maintained and kept for a minimum period of one year and must be submitted to the Licensing Authority upon request.


9. OTHERS


9.1 The license can be canceled if the premises violates the conditions more than three (3) times a year.


9.2 The license fee rate is based on the number of machines taking into account the provision in the Cyber ​​Center Act. The more machines, the higher the license fee. Recommended RM 50.00 for a computer.


9.3 The license deposit is also based on the total number of machines.


10. DESIGN PROPOSALS FOR CYBER CAFE/CYBER CENTER


10.1 The design of cyber cafes and cyber centers is divided into 3:


10.1.1 Design A: for premises operating in shopping malls.

10.1.2 Design B: for premises - premises that operate in office shop lots/ office buildings.

10.1.3 Design C: for premises operating in rural areas
