Boat Licensing

Application For Boat License



Every boat that plies in any port, river or place in Malaysia for the following purposes must be licensed:


a. Trade or business;


b. The transportation of any person other than for trade or business; or


c. Sports, leisure or recreational activity.


COMPLIANCE REQUIREMENTS


The legislation applies to all boats not exceeding 500 GT (Gross Tonnage).


OWNERSHIP ELIGIBILITY


An individual or group of individuals or companies shall not be deemed to be boat owner unless owned by an individual or group of individuals or companies with the following information:


a. Malaysian citizen; or


b. Company established in Malaysia and owned by Malaysian citizens (100%).


VALIDITY PERIOD OF BOAT LICENSE


Every Boat License issued must have a validity period not exceeding twelve (12) months from the date it is issued AND not exceeding the expiry date of the insurance policy, whichever is the earliest.


INSURANCE POLICY


It is a mandatory requirement of insurance policy or financial security for all vessels in the waters of Peninsular Malaysia, the waters of the Federal Territory of Labuan and / or the Exclusive Economic Zone of Malaysia.


This mandatory requirement also applies to all vessels including Malaysian vessels and boats licensed under 300 GT operating in the waters mentioned above.


The boat owners should obtain insurance policy or financial security from the licensed institution.


Each insurance policy must have a liability limit of not less than RM1,600,000.00 (USD400,000.00) and contain / cover five (5) items:


a. Crew abandonment, repatriation, illness, injury and loss of life;


b. Fixed and floating objects with the exception of ships;


c. Oil pollution liability;


d. Wreck removal; and


e. Passenger liability.


METHOD OF APPLICATION


Application for Boat Licensing must be submitted to the Boat Licensing Office (Regional Marine Department).


New Application


The application shall be accompanied with the following documents:


a. Application For Boat License Form (LAUT/LESENBOT/01/V2.0).


b. Declaration of Individual Ownership Form (LAUT/LESENBOT/02/V2.0); OR


c. Declaration of Body Corporate Ownership Form (LAUT/LESENBOT/03/V2.0).


d. Letter of Authorization if the owner appoint a representative for a license application.


Individual Ownership:

e. Original and certified true copy owner Identification Card.


OR


Body Corporate Ownership:

(original and certified true copy)

f. Certificate of registry under Registration of Businesses Act;


OR


g. Certificate of registry under Company Act.


h. Memorandum & Article of Company.


i. Return of Allotment of Share (Form 24).


j. Register of Directors, Managers and Secretaries and Changes of Particulars (Form 49).


k. Original and certified true copy Master’s Certificate of Competency (COC) – Malaysia citizen.


l. Original and certified true copy Master’s Seamen Card.


m. Original – Builder’s Certificate / Letter of Declaration Boat Construction with individual name / company as a buyer (new built); OR


n. Original – Letter / Receipt of Sales and Purchase (existing boat).


o. Original – Letter / Deletion Certificate (if boat previously registered / licensed under foreign flag).


p. Copy of boat statutory certificate (if boat previously registered under Malaysia Ship Registry / foreign flag):


- International Tonnage Certificate 1969;


- Cargo Ship Safety Equipment Certificate + Form E;


- International Load Line Certificate.


q. Picture of boat / General Arrangement Plan.


r. Insurance Policy.


Application Of Change Owner Information / Change Of Ownership / Amendment To Ownership Rights


The application shall be accompanied with the following documents:


a. Application Of Change Owner Information / Change Of Ownership / Amendment To Ownership Rights Form (LAUT/LESENBOT/04/V2.0).


b. Declaration of Individual Ownership Form (LAUT/LESENBOT/02/V2.0); OR


c. Declaration of Body Corporate Ownership Form (LAUT/LESENBOT/03/V2.0).


d. Letter of Authorization if the owner appoint a representative for this application.

Boat Licensing Process


The applicant will received a notification via email / phone of appointment to conduct a boat inspection.


How long it will take


Boat License will be processed and issued within 3 working days after confirmation / approval of inspection report along with complete supporting documents have been obtained.
